Suit by detained former Marine allowed to proceed

Source: Richmond Times-Dispatch, Va.儲存倉Aug. 02--A federal judge is allowing a suit by former Marine Brandon Raub to move forward against unnamed federal agents and others who played a role in arresting him and then ordered him to involuntarily enter a veteran's hospital in Salem for mental health care.In a 26-page memorandum opinion released this afternoon, U.S. District Judge Henry E. Hudson declined motions to dismiss key defendants in the case, concluding that "the allegations in Raub's complaint meet the bare minimum requirements to survive dismissal."Raub is claiming widespread violation of his constitutional rights when federal and county agents visited at his home in August last year and took him into custody. His legal case is being supported by the Rutherford Institute in Charlottesville.Hudson allowed further discovery in the case by Raub's lawyers to determine what federal agents and Chesterfield County police had learned about him before his arrest.Raub was detained Aug. 16 last year for a mental he迷你倉沙田lth examination and subsequently ordered to receive care at a hospital. He was released Aug. 23 after Raub's lawyers appealed and a Hopewell Circuit Court judge concluded that the paper work ordering Raub detained was faulty.Released on a technicality, according to his lawyers, Raub nevertheless is arguing that his detention was unconstitutional and lacked any substantive basis. Raub had been posting threatening statements on the Internet as well as political attacks against the government and a former Marine told authorities that Raub was beginning to act irrationally and making threats against people.Hudson indicated that he may issue a subsequent order once a more factual history of the case has been developed.
